When using the services offered here at the eWebAnalytics.com website, the user of these services agrees to the following terms of use. These terms of use are subject to change without notice.

This agreement can be terminated by eWebAnalytics.com or by the user at any time. When this service is terminated, the user agrees to remove eWebAnalytics.com code from all websites and web pages that the user has access to.

All services are offered "as is" and "as available". Users use eWebAnalytics.com entirely at their own risk. eWebAnalytics.com is not responsible for any of the following: any damages (inlcuding data loss) for any reason either as a direct result of using the eWebAnalytics.com service or as a consequence of using this service even if these damages are caused by an interruption of eWebAnalytics.com service due to suspension, termination or if eWebAnalytics.com fails to provide the service.

eWebAnalytics.com owns the data collected by the eWebAnalytics.com service and offers it to the users of eWebAnalytics.com as a service. The data provided to the user by eWebAnalytics.com can be utilized for any legal purpose.

However, websites are prohibited from inflating hits by generating false hits.

In addition, the eWebAnalytics.com service cannot be used for gathering information about or responses from spam email (UCE or unsolicited email). Any and all accounts that use eWebAnalytics.com in this manner will be terminated and a minimum charge of $250 will be levied plus another $125 per hour for dealing with any spam complaints that involve the terminated user.

In addition sexual, racist or violent websites or pages, or websites or web pages that further such content are prohibited by eWebAnalytics.com. Any agreements with eWebAnalytics.com for sites that display pages with sexual, racist or violent material will be terminated immediately and any money paid by such websites to eWebAnalytics.com will not be refunded.

eWebAnalytics.com will never divulge a user's email address or other personal information to a third party without the user's permission, unless under orders from a proper law authority.

A user will pay eWebAnalytics.com with monthly automatic charges to the user's credit card account. A user can cancel an account before the next billing to prevent any further charges. Delinquent accounts or accounts in which eWebAnalytics.com is unable to charge the designated credit card account will be terminated. Any past due amounts will be referred to a collection agency.

Records and monthly statements are maintained electronically by eWebAnalytics.com. In the event of an error, users of the eWebAnalytics.com service must contact eWebAnalytics.com within 30 days and notify eWebAnalytics.com of any errors or omissions. If the user fails to notify eWebAnalytics.com within 30 days, it is assumed that the user has agreed to the information contained in the user's electronic billing and no refund or adjustment will be forthcoming.

This Agreement will be construed and enforced according to the laws of the State of Utah. Any disputes will be brought before a court in Salt Lake County, Utah.

The user of eWebAnalytics.com services, agrees to defend, indemnify and hold eWebAnalytics.com harmless from and against any and all claims, losses, liability costs and expenses (including but not limited to attorney's fees) arising from the user's violation of this agreement or any third-party's rights, including but not limited to infringement of any copyright, violation of any proprietary right and invasion of any privacy rights. This obligation shall survive any termination of this agreement. Our liability will not exceed the monies paid by the user for eWebAnalytics.com services.
